Ian Hacking has defined himself as a philosopher in the analytic tradition. However, he has also recognized the profound influence that Michel Foucault had on much of his work. In this article I analyse the specific imprint of certain works by Foucault—in particular Les mots et les choses—in two of Hacking’s early works: Why Does Language Matter to Philosophy? and The Emergence of Probability. I propose that these texts not only share a debt of Foucauldian thought, but also are part (...) of what I believe is Hacking’s central project: the analysis of the historical and situated conditions of possibility for the emergence of concepts and of objects, inspired also by the French philosopher’s thought. Lorraine Daston ha señalado la influencia que The emergence of probability de Ian Hacking ha tenido en su trayectoria intelectual y en su elección de la etiqueta epistemología histórica para describir su trabajo. Hacking, por su parte, ha respondido a estos señalamientos que, en primer lugar, Daston y sus colegas no hacen epistemología, sino que más bien estudian conceptos epistemológicos como objetos que evolucionan y mutan; en segundo lugar, que su trabajo sobre la probabilidad no es epistemología histórica sino, en (...) todo caso, lo que él llama metaepistemología histórica o, mejor aún, ontología histórica. En el presente trabajo, analizo en qué forma entienden Daston y Hacking el tipo de investigación que denominan respectivamente epistemología y metaepistemología histórica, y exploro sus convergencias y divergencias con el fin de establecer posibles relaciones, intereses y antecedentes compartidos. Por último, sostengo que la obra de Hacking puede ser visualizada como resultado de investigaciones que caracterizan a la epistemología histórica, como consecuencia de su interés, estimulado por la lectura de Michel Foucault, en el análisis de las condiciones históricas de posibilidad para la emergencia de conceptos y objetos científicos. This original article outlines a theoretical path and posterior critical analysis regarding two relevant matters in modern nursing: patterns of knowing in nursing and commodification contexts in contemporary health systems. The aim of our manuscript is to examine the development of basic and contextual nursing knowledge in commodified contexts. For this purpose, we outline a discussion and reflexive dialogue based on a literature search and our clinical experience. To lay the foundation for an informed discussion, we conducted a literature search (...) and selected relevant articles in English, Spanish, and Portuguese that included contents on patterns of knowing, commodification, and nursing published from 1978 to 2017. Globalization, commodification, and austerity measures seem to have negative effects on nursing. Work conditions are worsening, deteriorating nurse–patient relationships, and limiting reflection on practice. Nurses must develop knowledge to challenge and participate in institutional organization and public health policies. Development of nursing knowledge may be difficult to achieve in commodified environments. Consequently, therapeutic care relationships, healthcare services, and nurses' own health are compromised. However, by obtaining organizational, sociopolitical, and emancipatory knowledge, nurses can use strategies to adapt to or resist commodified contexts while constructing basic knowledge. (shrink)

This book offers a systematized overview of Ian Hacking's work. It presents Hacking’s oeuvre as a network made up of four interconnected key nodes: styles of scientific thinking & doing, probability, making up people, and experimentation and scientific realism. Its central claim is that Michel Foucault’s influence is the underlying thread that runs across the Canadian philosopher’s oeuvre. Foucault’s imprint on Hacking’s work is usually mentioned in relation to styles of scientific reasoning and the human sciences. This research shows that (...) Foucault’s influence can in fact be extended beyond these fields, insofar the underlying interest to the whole corpus of Hacking’s works, namely the analysis of conditions of possibility, is stimulated by the work of the French philosopher. Displacing scientific realism as the central focus of Ian Hacking’s oeuvre opens up a very different landscape, showing, behind the apparent dispersion of his works, the far-reaching interest that amalgamates them: to reveal the historical and situated conditions of possibility for the emergence of scientific objects and concepts. This book shows how Hacking’s deployment concepts such as looping effect, making up people, and interactive kinds, can complement Foucauldian analyses, offering an overarching perspective that can provide a better explanation of the objects of the human sciences and their behaviors. This research presents an analysis of the learning strategies employed by students during confinement due to Covid-19 in the year 2021. The study sample consisted of 200 students from the Licenciado Benito Juárez García high school of the morning shift of the Benemérita Universidad Autónoma de Puebla. A survey was applied to measure the degree of satisfaction in relation to their use and impact on the acquisition of knowledge, allowing them to be more self-taught.The results show that the hypothesis was (...) partially fulfilled, since practice and organization are the learning strategies that most supported them in learning. BackgroundThe COVID-19 pandemic has resulted in some populations being confined to their homes as part of infection control measures. This situation can be hard to cope with due to separation from loved ones, prohibition of regular activities, fear of infection, loss of freedom, and so on. These negative impacts cause considerable psychological stress, and all the more so when the situation continues for an extended period, as was the case in Spain. The present study was aimed at investigating the effects (...) of COVID-19 quarantine on the emotional functioning of confined Spanish individuals after 8 weeks of lockdown by means of a cross-sectional study. The possible associations between changes in emotional functioning and demographic variables, health habits, social support, and resilience were also analyzed.MethodsA total of 906 Spanish adults completed an online survey to gather information about their prevailing mood and affects, using the Positive and Negative Affect Schedule, and other variables related to their habits and protective factors.FindingsAs expected, the data indicated an increase in negative affects and a decrease in positive affects after 8 weeks under lockdown, as well as a general decline in overall mood. The largest increases in negative affects were observed in young adults and women. We did not find any differences between people who were or were not diagnosed with COVID-19. Adhering to a routine, maintaining the same weight, and moderate physical exercise were associated with fewer negative affects, which indicates they are important protective factors, as are perceived social support and resilience.ConclusionIn order to mitigate the psychological impact of confinement, it is important to develop psychoeducational measures that encourage subjects to adhere to health habits and promote social support and resilience as protective factors. A special preventive focus should be placed on the most vulnerable population groups, namely women and young adults. For a public health lockdown to succeed, its negative consequences must be minimized insofar as possible through adequate knowledge of the risk factors and protective factors, and by means of prevention-oriented organization. For almost 50 years, the Council of Europe through a series of documents has been helping to build up a set of rules, principles, and strategies related to culture, environment, ethics, and sustainable development. At the moment, one of the most important aims of the Council of Europe’s agenda deals with the elaboration of the General Principles for the Protection of the Environment and Sustainable Development, as raised in document CO-DBP (2003)2 related to the environmental subject. The intention of the (...) Council of Europe is to encourage national authorities to implement these General Principles into their national environmental policies. These principles should have an important effect, especially in those countries which are new members of the European Union. The primary target of this paper is the study of these principles and the setting of their entailed implications in order to establish a relation between values and policy making. Quite often, the conclusions adopted by the agreements generated within the framework of the European Union are controversial. Therefore, a study aiming to lay the foundations of these principles will make the exchange of ideas easier, providing a wider and more detailed scope in the European environmental policy. (shrink)

To prevent domains from cyber-piracy, the WIPO offers private and confidential procedures tasked to address the legitimate use of a domain name. WIPO domain name arbitration consists of an alternative dispute resolution process in which one or more panelists make a binding decision over the legitimacy of a domain. This article investigates the structure of the discourse of this professional genre. Following Maley, this study focuses, first, on spotting the generic moves of WIPO domain name arbitration decisions. Second, the analysis (...) unveils patterns shaping WIPO domain name arbitration decisions, hence exploring how discursive features work within this specialized discourse. Third, it examines whether corpus data reveal that this type of professional discourse has entered into a process of standardization. The study is based on Bhatia’s multi-perspective four-space model of discourse. This analytical framework emphasizes a multidisciplinary and multidimensional perspective which highlights that discourse is indistinguishable from constructing reality. (shrink)

As an alternative dispute resolution procedure, Domain Name Arbitration addresses not only contentions regarding the ownership of web pages, but also infringements of the Intellectual Property law such as cyber squatting or Internet piracy. In this spirit, panelists of the World Intellectual Property Organization enact law in accordance with what the involved parties provide them as burden of proof. Following this line of thought, we can assume that one party may remain unrepresented when it is not able to accomplish legal (...) procedures successfully. Nevertheless, does this kind of asymmetry always function in the way that we presume? This paper sets out to study how WIPO panelists tackle knowledge asymmetries when being manifested in Domain Name Arbitration. In particular, this paper concentrates on comparing two Domain Name Arbitration processes in which knowledge asymmetries play a significant role in the panelist’s final-and legally binding- decision. This analysis also examines how specific text-internal features give us a hint of unbalanced relationships between the Complainant and the Respondent of a Domain Name Arbitration process. It endeavors, thus, to understand how lexical, rhetorical-grammatical and discursive features work within discourse and may reach to influence the communicative act itself. Following Vijay K. Bhatia’s critical discourse analysis as main theoretical framework, this paper tries to comprehend the role asymmetries play in enacting Domain Name law. (shrink)

This article analyzes the relationship between corporate social responsibility (CSR) decoupling and financial market outcomes. CSR decoupling refers to the gap between CSR disclosure and CSR performance. More specifically, we analyze the effect of CSR decoupling on analysts’ forecast errors, cost of capital, and access to finance. We also examine the moderating effect of forecast errors on relationships between CSR decoupling and cost of capital and access to finance. For a sample of U.S. firms consisting of 7,681 firm-year observations for (...) the period 2006–2015, our empirical evidence supports the idea that a wider gap results in higher analysts’ forecast errors, a greater cost of capital, and reduced access to finance. In addition, our results show that forecast errors enhance the effect of the CSR decoupling on cost of capital and access to financial resources. We also note that external monitoring, in the form of greater analysts’ coverage, reduces CSR decoupling. (shrink)

L’article prend en considération la façon dont différents auteurs rassemblés sous l’étiquette générale de « présocratiques » commençaient leurs discours. Dans le contexte d’une transmission essentiellement orale tel que celui de la culture de la Grèce archaïque, l’incipit prend une importance fondamentale, dans la mesure où il pose les bases de la communication, définit le type de message que l’auteur veut transmettre et indique dans quelle voie il s’engage. Il donne donc des indications non seulement sur le type de texte, (...) mais aussi sur le genre de public auquel ce texte était adressé. S’il s’agit d’un public restreint et choisi, l’incipit est généralement élitiste, obscur, et fait référence à un code auquel il est difficile d’accéder ou, comme dans le cas de l’écrit d’Alcméon, mise sur la difficulté d’une entreprise que les disciples doivent surmonter à l’aide de l’enseignement du maître. Si le texte est destiné à un public plus large d’amateurs cultivés, il mise sur des phrases ronflantes qui suscitent des visions grandioses et des émotions et placent l’orateur dans une position dominante vis-à-vis de l’auditoire. Ici on prend en considération en particulier les incipit de quatre auteurs assez différents les uns des autres, de la fin du vie au dernier tiers du ve siècle av. J.‑C. : Héraclite, Alcméon, Anaxagore et Diogène d’Apollonie. En recourant à l’analyse linguistique et en les confrontant avec d’autres textes de même époque, on cherche à définir la particularité de chaque texte en relation avec le message qu’il véhicule et avec ses destinataires. Les résultats de cette analyse invitent à reconsidérer la méthode à employer pour aborder les fragments des auteurs dits présocratiques et à se libérer du modèle herméneutique « anthologique » d’Aristote qui vise à rechercher un « système » philosophique et néglige le rythme prosodique, l’harmonie de la langue, le caractère persuasif des textes et leur contexte culturel. El problema del origen de la vocación en el pensamiento de José Ortega y Gasset puede abordarse desde dos perspectivas de diversa profundidad: la primera,referida al fundamento de la vocación en el sujeto; la segunda, sobre la posibilidad de una causa de la vocación que sea exterior al sujeto mismo. La primera vía nos llevará a descubrir que la vocación surge de la más individual de nuestras dimensiones: el alma. Ésta es la sede de nuestros sentimientos, entre los cuales el (...) amor se manifiesta como el sentimiento fundamental, principio de todos los demás. Así, el problema del origen de la vocación en el sujeto encuentra,desde la comprensión del sentimiento amoroso, su pleno significado. Many have contended that non-classical logicians have failed at providing evidence of paraconsistent logics being applicable in cases of inconsistency toleration in the sciences. With this in mind, my main concern here is methodological. I aim at addressing the question of how should we study and explain cases of inconsistent science, using paraconsistent tools, without ruining into the most common methodological mistakes. My response is divided into two main parts: first, I provide some methodological guidance on how to approach cases (...) of inconsistent science; and second, I focus on a peculiar type of formal methodologies for the scrutiny of inconsistent reasoning, the _Paraconsistent Alternative Approach_ (henceforth, PAA) and argue that PAA can enhance a more accurate understanding of sensible reasoning in inconsistent contexts. La complejidad de los fenómenos sociales que presenciamos en la actualidad resulta inabarcable exclusivamente desde la categoría de pobreza y sin embargo, el diseño e implementación de políticas sociales se continúa abordando desde un paradigma o esquema pensado en clave desde la noción de pobreza. Teniendo en cuenta estas ideas en el presente artículo, se propone analizar la categoría de “pobreza”, intentando discutir en torno a las siguientes cuestiones: ¿cuál es el lugar que debería ocupar la noción de pobreza en (...) el diseño de un diagnóstico de la situación social actual? ¿En qué medida la pobreza es una noción adecuada como ordenadora del diseño de políticas sociales? ¿Qué implicancias tiene pasar de una mirada centrada en el problema de la pobreza hacia otra atenta a la diversidad de configuraciones sociales en que transcurre la vida cotidiana? ¿Cuál es el lugar que le corresponde a la idea de pobreza en la matriz a partir de la cuál pensar actualmente la política social y las respuestas que éstas brindan desde el Estado? En este artículo revisaremos los puntos de contacto entre la concepción althusseriana de ideología y la noción de conocimiento común expuesta por Bachelard y sus relaciones con la práctica científica. Encontramos en la obra de Althusser, resonancias de las concepciones de Bachelard, en la mirada crítica hacia el empirismo, las influencias del psicoanálisis, el hincapié en el trabajo de ruptura y construcción de la ciencia frente al conocimiento común (Bachelard) o frente a la ideología (Althusser). En términos amplios, podemos decir (...) que ambos comparten la crítica a la operación de lectura inmediata-ideológica, que, fundamentada en una pretendida transparencia de la visión en la cual los los ‘hechos’ tienen la evidencia de datos absolutos que toma como se ‘dan’, sin pedirles cuenta. Aquí, la ruptura se establece en el instante mismo en que se comprende que ninguna lectura es inocente sino que se asienta en una concepción del conocimiento, más o menos consciente. En este sentido, Althusser señala la necesidad en la práctica científica de formular la pregunta por lo ‘dado’ y pensar la estructura teórica del objeto-problema. Tal señalamiento remite al texto de Bachelard: “Nada es espontáneo. Nada está dado. Todo se construye.”. (shrink)

The main goal of the essays in the special issue is reflecting on catastrophe and on its perception within the areas of contemporary human and social sciences; that is, revising the specific forms of the relationship between man, nature, society, as well as the relationship risk-fear-security, between society and government.

El centro histórico de San Miguel de Tucumán está conformado por el área fundacional (1685) y el área del ensanche (1872). En total reúne 252 manzanas que concentran la mayor cantidad de las expresiones del patrimonio arquitectónico y urbano local y, a la manera de un palimpsesto, aún se leen las huellas de la cuadrícula fundacional, las intervenciones urbanas decimonónicas y la impronta de las construcciones del siglo XIX. Sin embargo, desde las últimas décadas del siglo XX, se manifiestan notas (...) de la modernidad que produjeron profundas tensiones. En un ambiente pluritemporal, la coexistencia del centro histórico con el área central encuentra una condición paradojal, la permanencia y el cambio, en un escenario de tensión como en la mayoría de sus pares latinoamericanas. Se define entonces un cuadro de situación compartido que nos habilita a reflexionar sobre la complejización del abordaje patrimonial en la actualidad. En la década de 1990, desde el Instituto de Historia (FAU, UNT) se realiza una significativa contribución que aporta entre otras ideas, bases técnico-legales para la protección del patrimonio. Los resultados obtenidos han marcado el pulso del patrimonio en la ciudad y, aún pasados más de 20 años, su impronta se mantiene. Sobre la base de esta construcción metodológica y normativa, se realiza un estudio en profundidad desde la perspectiva histórico-patrimonial. Se analizan los trazos de estas ideas-acciones en la evolución de la ciudad y se recuperan y amplían diferentes nociones que nos permiten interpretar los conflictos y las oportunidades que acompañan a los procesos de cambio y transformación sucedidos, exponiendo sus tensiones y divergencias, así como los mecanismos que se activan para su salvaguarda. This study examines whether character strengths predict resilience (operationalized as stable or higher mental health and subjective well-being despite an adverse event) over a period of approximately one month during the COVID-19 pandemic lockdown in Spain. Using a longitudinal design, participants (N = 348 adults) completed online measures of sociodemographic data, information regarding their situation in relation to the COVID-19, character strengths, general mental health, life satisfaction, positive affect and negative affect. All variables were measured at Time 1 and Time (...) 2, except for sociodemographic and most COVID-related information (Time 1 only). Time 1 data collection was conducted between March 21, 2020 and April 2, 2020, i.e., approximately the second week of lockdown in Spain. Time 2 data collection was conducted between April 24, 2020 and May 18, 2020, after the Spanish government announced ita intention to progressively release the lockdown. A principal component analysis of character strengths was conducted. Five character strength factors were extracted: fortitude, goodness, intellectual, interpersonal, and restraint. Factor structures at Times 1 and 2 were highly consistent. All character strength factors at Time 1 correlated positively with life satisfaction and positive affect, and negatively with negative affect and mental health at T2 (higher scores in the mental health measure indicate poorer mental health). Fortitude strengths showed the highest correlations. We conducted a series of regression analyses with strength factors at Time 1 as predictors, and mental health, life satisfaction, and positive and negative affect as dependent variables, controlling for their baseline levels. To test the directionality of the relationship between strengths and the dependent variables, all analyses were reversed. All character strength factors predicted an increase in mental health. They also predicted positive affect, with the exception of strengths of restraint. Fortitude, intellectual and interpersonal strengths predicted an increase in life satisfaction. Finally, fortitude strengths, interpersonal strengths, and strengths of restraint, predicted a decrease in negative affect. None of the reversed analyses yielded significant effects. Limitations, implications, and possible character strengths-based interventions aimed at promoting mental health in the COVID-19 pandemic are discussed. (shrink)

We highlight how Corporate Social Responsibility can be strategically used against the negative perception from earnings management. Using international data, we analyse the effect of CSR and EM on the cost of capital and corporate reputation. Results confirm that CSR strategy is positively valued by investors and other stakeholders. Contrary to EM, CSR has a positive effect on corporate reputation and lowers the cost of capital. In addition, we also find that the favourable effect of CSR on cost of capital (...) is consistently more intense in firms that show signs of EM indicating that the market does not identify when CSR practices are used as a strategy to mask EM. We also demonstrate how institutional factors influence the above relationship. (shrink)

Diego Pérez de Valdivia (1525-1589), uno de los más brillantes discípulos de Juan de Ávila, biblista y profesor de Sagrada Escrituras, ha sido autor de un sermón que se transcribe aquí por primera vez y del que se ofrece una propuesta interpretativa. Por carecer de lugar y año, resulta especialmente problemática su contextualización en la biografía del sacerdote baezano y, en general, en el marco de su época. Sin embargo, la textura espiritual del sermón y la forma de vertebrar el (...) lenguaje religioso en él, dibujan un escenario catequético en el cual este sermón, dedicado al capítulo 22 del evangelio de Mateo, se insertaría como una pieza clave. Diego Pérez podría dirigirse no solo a un público indiferenciado sino también o, especialmente, a un sector de indecisos, dudosos o simplemente de católicos, cuyo arraigo en la fe cristiana, fuera o no reciente, arrastaba un profundo déficit de formación religiosa. Este trabajo insiste en la utilidad de la distinción entre medios y consecuencias en la atribución de responsabilidad penal. La estrategia argumental se basa en algunas de las principales intuiciones de la doctrina del doble efecto. En particular, se analiza el modo en que esta doctrina moral traza la diferencia entre daño instrumental y daño incidental. Dado que en la filosofía moral contemporánea se ha criticado severamente esa distinción, se elabora una respuesta a esas críticas. Finalmente, se subraya no sólo (...) en qué sentido es diferente intentar y prever un daño sino también por qué los daños instrumentales cuentan también como daños intentados por el agente. (shrink)

The commodification of health care, particularly primary care, presents challenges to care and knowledge development. The purpose of this study is to examine how nurses perceive and develop their knowledge in a commodified context. A mixed‐methods study was conducted that included a closed‐question survey and in‐depth interviews with nurses in public primary care in Catalonia. There were 104 valid responses to the questionnaire and 10 in‐depth interviews. The main findings of the survey were related to workload and limited time for (...) nursing care. Six themes emerged from the in‐depth interviews: (1) limited time for nursing, (2) feelings of burnout, (3) awareness of patient and family satisfaction, (4) organizational factors that favor nurses' needs, (5) organizational factors that hinder nurses' needs, and finally (6) public administration requirements. Participants perceive excessive workload and time constraints and feel that this affects their nursing care and their physical and mental health. However, nurses purposefully use knowledge patterns to cope with the problems associated with commodification. Nurses have multidimensional, contextualized, and integrated knowledge that allows them to optimize their care based on the needs of their patients. This research examines many challenges related to nursing practice and the nursing discipline and opens the door for further research that encompasses all areas of nursing. (shrink)

Healthcare professionals cannot lose sight of the fact that precariousness is a deeply human circumstance that demands unconditional respect for the dying patient. This descriptive study is a bio-legislation re ection about digni ed death in cases of diseases entailing long processes of deterioration and physical and psychological suffering. Comparative legislation and the most emblematic jurisprudence will be considered, in light of the fundamental rights involved. It is concluded that it is legitimate to respect the patient’s wishes regarding his or (...) her dying process, so long as their dignity is not violated: any conduct that leads them to death or which deliberately causes it cannot be allowed. Legal dogmatics often claims that it plays a necessary role in identifying legal rules and in solving their indeterminacies. Thus, legal dogmatics is to be viewed as an indispensable complement to legislation. Like legislation, dogmatics also attempts to provide judges with precise guidelines to help them pass the right decisions and avoid the arbitrary ones. Only under this assumption does dogmatics help to make more predictable decisions. However, (...) the problem of dogmatics consists that the search for precision which is to intended to limit the arbitrariness of judicial decisions calls for distinctions that are per se arbitrary ones. In some cases, this arbitrariness results from an indeterminacy generated by vague rules, while in other cases the application of precise rules leads to arbitrariness because officials depart from the reasons that ground them. The challenge of dogmatics is to show that its contribution to rationality can be perceived as an improvement on the legislator’s contribution. That is, dogmatics must show why its rules can succeed where legislation inevitably fails for conceptual reasons. The authors of this paper claim the opposite. The application of dogmatic rules has the same conceptual difficulties as the application of legislated rules alone.Moreover, dogmatic solutions often contend with other formal justifications, i.e., reasons which ground legislated rules. En este trabajo pretendo mostrar que el derecho penal contemporáneo no ha encontrado todavía buenas soluciones a las difi cultades conceptuales y normativas planteadas por los casos de ignorancia deliberada. Las difi cultades surgen, en buena medida, al tratar de resolver estas situaciones mediante una herramienta equivocada: ampliando el concepto de dolo eventual. Este recurso conceptual intenta encontrar justifi cación para un castigo severo –el tipo de castigo paradigmáticamente ligado a los delitos intencionales–pero fracasa porque el dolo eventual requiere que (...) exista conocimiento. En contraste con ello, sugiero que la ignorancia deliberada puede ser vista, en algunas situaciones, como una especifi cación del fraude de ley. Esta sería la razón por la que esta fi gura puede algunas veces parecer más grave que la imprudencia. (shrink)

El trabajo pretende mostrar que la expansión de la dogmática, sobre todo en el discurso penal, representa un desafío al legislador y cuál es el precio que debemos pagar por ello. La dogmática, al igual que la legislación, necesita ofrecer al juez pautas precisas que sirvan para delimitar las decisiones correctas y, en ese mismo sentido, identificar a las que se consideran arbitrarias. Sólo bajo este supuesto la dogmática contribuye a lograr decisiones más previsibles. La dificultad radica en que la (...) búsqueda de precisión puede limitar la arbitrariedad de los órganos de aplicación, pero, a la vez, la precisión introduce distinciones arbitrarias. En ciertos casos la arbitrariedad se produce por la indeterminación que generan las normas imprecisas y en otros casos, la arbitrariedad consiste en que al aplicar normas precisas, los funcionarios se apartan de las razones que justifican a esas normas. El desafío para la dogmática es mostrar que su contribución a la racionalidad puede superar a las que elabora el legislador. Es decir, debe mostrar por qué sus normas pueden tener éxito donde el legislador, por cuestiones conceptuales, inevitablemente fracasa. Los autores de este trabajo sostienen que la incorporación de normas dogmáticas en el horizonte de justificación de las decisiones no solo posee las mismas dificultades conceptuales que las del legislador sino que sus soluciones compiten con otras justificaciones formales, e.g. normas legisladas y, con frecuencia, suponen una tensión entre las palabras de la ley y lo que los dogmáticos dicen que dice el legislador. This article aims to analyze and discuss the sixteen studies that compose the book edited by Enrique Hülsz Piccone, Nuevos ensayos sobre Heráclito, which is the latest compendium of studies on the philosophy of the Obscure of Ephesus. This volume gathers the proceedings of the Second Symposium Heracliteum held in June 2006 at the Facultad de Filosofía y Letras, UNAM, where some of the most renowned specialists of the international community came together to present their work on Heraclitus.
